Court holds ban on non-licensees mailing handguns to be unconstitutional.
Good Catch! Actually what is happening here is that the
Executive Branch, Department of Justice (DOJ), has ruled, via their legal opinion, that this 1927 law is unconstitutional, thus, they will not enforce it, and that is a
Departmental Policy Decision. What they have done is to present their opinion to be challenged
in court by those who disagree, OR give
Congress an opportunity to
repeal this law. Whatever the case, they are saying they will not prosecute anyone who violates that law. What will be interesting to see is if the carriers (USPS, FedEx, UPS,
et. al. ) will start shipping handguns. I suspect that some anti-gun organization will challenge their decision in court which, if the DOJ has done their homework, is just what they wanted.
